(f) The license and the decommissioning plan or License Termination Plan shall be the primary source of information for determining whether a facility needs to be closed and decommissioned. The license and the decommissioning plan or License Termination Plan shall be the primary source of information for determining whether a site is suitable for unrestricted use. The license and the decommissioning plan or License Termination Plan shall be the primary source of information for determining whether a facility or site is in compliance with decommissioning requirements. In addition, the license shall be the primary source of information for determining whether the license should be issued to any new applicant or renewed as a current license holder. Applicants for all licensed activities under this subchapter, and license holders, shall be required to certify that they are in compliance with the requirements of the license and that they are in compliance with the requirements of the decommissioning plan or License Termination Plan if the licensee has submitted one. The Commission may request that additional information be submitted to it in order to assist the Commission in determining compliance with these requirements. If the licensee fails to submit the required information or certification, or if the Commission determines that the licensee is not in compliance with the decommissioning plan or License Termination Plan, the facility or site shall not be subject to further licensing activities under this subchapter, except where a decision to license is made by the Commission in the absence of a decommissioning plan or License Termination Plan.

(g) The licensee has submitted a signed commitment to the Commission that the licensee will undertake to decommission the facility or site in accordance with the decommissioning plan or License Termination Plan within 10 years from the date the Commission approves the decommissioning plan or License Termination Plan;

The site selection criteria provide guidance on the initial selection of a site for a decommissioning project. The criteria help to ensure that a site is selected that is the best choice for the decommissioning project and that satisfies the requirements of this subpart. They are based on the following considerations:

(i) Operating practices, including the criteria described in the criteria for safe operating practices in appendix A to 10 CFR part 40, which are applicable to the type of decommissioning in which a site is being considered;
